1. What this covers

These terms govern your use of this website. They do not govern any factoring relationship with Capital Hart Corp — that is set out entirely in your signed factoring agreement, which controls if the two ever conflict.

2. Nothing here is an offer

The rates, terms and program features described on this site are marketing descriptions, not an offer of credit or a binding quote. “Rates as low as 2%” is the lowest rate available under our program; the rate offered to any particular carrier depends on invoice volume, debtor credit quality and program terms. Same-day funding applies to complete, verified invoice packets received before the daily cut-off on business days. Non-recourse protection covers debtor insolvency as defined in the factoring agreement and does not cover every reason an invoice may go unpaid. All programs are subject to approval.

The guides in our Resources section are general information about how freight factoring works. They are not financial, tax or legal advice and are not tailored to your business. Talk to your own advisors before making a decision.

4. Using the site

You agree not to:

  • Submit false information, or another party's information without authority.
  • Attempt to gain unauthorized access to any part of the site or its systems.
  • Use automated means to scrape, overload or interfere with the site.
  • Use the site for any unlawful purpose.

5. Third-party links

This site links to third-party services, including the client portal. We do not control those services and are not responsible for their content, terms, or practices.

6. Intellectual property

The Capital Hart name, logo, and the text and design of this site are owned by Capital Hart Corp. You may not reproduce them commercially without written permission.

7. No warranty

The site is provided “as is.” We work to keep it accurate and available but do not warrant that it will be uninterrupted, error-free, or that the information on it is complete or current at every moment.

8. Limitation of liability

To the fullest extent permitted by law, Capital Hart Corp is not liable for indirect, incidental or consequential damages arising from your use of this website. TODO-COUNSEL: confirm the cap and the carve-outs required in the governing jurisdiction.
